1. Scope
These Terms & Conditions apply to all deliveries and services of Lichtbild Manufaktur to consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

3. Contract Formation
3.1 The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.
3.2 By clicking the order button, you place a binding order for the products in your cart. The contract is concluded when we accept your order by sending an explicit order confirmation via email or by shipping the goods.
3.3 You add products to the cart, proceed through checkout, and can correct your entries at any time. Before submitting your order, all data is summarized in an order overview where it can be reviewed and modified.
3.4 After placing your order, you will automatically receive an email confirming receipt of your order. This does not yet constitute acceptance.
3.5 The contract language is German.
3.6 A preview of the model may optionally be generated before placing the order. After receiving your order, we typically begin individual production immediately.
3.7 For city/terrain models, we use the geodata available at the time of ordering (e.g. OpenStreetMap). Changes to motif, section, colors, or texts are no longer possible after the order is placed.
3.8 We reserve the right to contest or correct contracts in case of obvious errors (typos, calculation errors, display errors).
4. Right of Withdrawal / Exclusion
We predominantly manufacture goods that are not prefabricated and whose production is based on your individual selection or specifications. For such custom-made goods, there is no right of withdrawal (§ 312g(2)(1) BGB). Statutory warranty rights remain unaffected.
Since production typically begins immediately after your order is received and the goods are manufactured to your specifications, cancellation after placing the order is generally excluded.
For non-personalized accessories (e.g. our stainless steel mounts), the right of withdrawal applies per § 355 BGB, provided the goods are returned unused, undamaged, and in their original condition including packaging.
In case of withdrawal, you bear the costs of outbound and return shipping if the delivered goods match the order. Refunds are limited to the product value; shipping costs already incurred cannot be refunded.
5. Prices, Shipping & Vouchers
5.1 All prices are in Euros including statutory VAT and other price components.
5.2 Shipping costs are charged as a flat rate; the amount is shown during the order process. Any island/special surcharges will be communicated before contract conclusion.
5.3 Promotional or gift vouchers can only be redeemed under the respective conditions; cash payment is excluded.
6. Gift Vouchers
6.1 Gift vouchers are delivered digitally (via email as code or PDF) after payment. No shipping costs apply.
6.2 Vouchers can be redeemed for all items in our shop, except for the purchase of additional gift vouchers. The code must be entered before completing the order.
6.3 Gift vouchers are valid until the end of the third year after purchase (statutory limitation period, §§ 195, 199 BGB).
6.4 If the voucher value is insufficient, the remaining amount can be paid with any offered payment method. Remaining balance stays valid until the expiry date.
6.5 Cash payment of the voucher value is excluded. The balance is not interest-bearing.
6.6 Gift vouchers are transferable.
6.7 The statutory right of withdrawal applies to gift voucher purchases (see § 4), as long as the voucher has not yet been redeemed.
7. Delivery, Risk Transfer & Shipping Damage
7.1 Delivery within the EU via commissioned carriers. The shipping carrier is displayed in the checkout. We reserve the right to change the carrier at any time. Delivery time estimates are non-binding unless explicitly confirmed in writing.
7.2 For shipments outside the EU, we ship via DAP (Delivered at Place) or DDP (Delivered Duty Paid) depending on the destination country. Which term applies to your country is transparently shown in the cart and checkout. We strive to always comply with the latest customs and import regulations for each country.
7.3 If a shipment is returned to us due to non-collection or failed delivery, we may charge the actual return and re-shipping costs plus a reasonable handling fee.
7.4 Risk of accidental loss or deterioration passes to you upon delivery of the goods.
7.5 If goods arrive with visible shipping damage, please report this to the carrier immediately and contact us. Failure to do so does not affect your statutory rights but helps us assert our own claims against the carrier.
7.6 We are entitled to make partial deliveries if reasonable for you. Any additional costs from partial deliveries are borne by us.
7.7 We do not assume procurement risk. If goods cannot be delivered through no fault of our own, we may withdraw from the contract and will refund any payments already made without delay.
8. Payment
Payment is made using the methods offered in the checkout. Unless otherwise stated, the purchase price is due immediately upon conclusion of the contract.
9. Retention of Title
The goods remain our property until full payment has been received.
10. Warranty
Statutory warranty applies. Colors, surfaces, and structures shown in product descriptions and previews may vary slightly due to production and display differences; such deviations do not constitute a defect as long as they are reasonable and do not impair usability. Statutory rights remain unaffected.
11. Liability
We are liable without limitation in accordance with statutory provisions for (a) injury to life, body, or health, (b) intent and gross negligence, (c) guarantees expressly given, and (d) under the Product Liability Act.
In cases of slight negligence involving essential contractual obligations, our liability is limited to foreseeable, contract-typical damages.
We do not assume liability for the accuracy or completeness of geodata or other third-party data (e.g. OpenStreetMap). Our models are decorative/artistic representations and not intended for planning, surveying, safety, or navigation purposes.
12. Customer Content & Rights
12.1 Content you provide (e.g. images, texts, geodata) may only be used by us for order processing. You confirm that you hold all necessary rights and indemnify us against third-party claims.
12.2 Minor production tolerances (e.g. slight color or dimensional deviations) are technically unavoidable and reasonable. Statutory rights remain unaffected.
12.3 We retain all copyrights and intellectual property rights to our own designs, models, software, and graphics.
12.4 By completing your order, you confirm that the chosen section, scale, and color selection are correct. Subsequent changes are only possible via a new order.
13. Contract Language, Storage & Electronic Invoices
The contract language is German. Order data and T&Cs are sent to you via email; T&Cs can also be accessed on this page at any time. Invoices are generally provided electronically (e.g. via email as PDF).
14. Set-off & Retention
You may only set off claims that are legally established, undisputed, or acknowledged by us. You may only exercise a right of retention insofar as the claims arise from the same contractual relationship.
15. Dispute Resolution
We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
16. Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the consumer's country of habitual residence remain unaffected.
If any provision is invalid, the remaining provisions shall remain in effect.
17. Force Majeure
Events beyond our control (e.g. strikes, natural disasters, pandemics, government measures, supply chain disruptions) exempt us from our obligation to perform for the duration of the disruption. Payments already made will be refunded as required by law. We will notify you of such events without undue delay.
